PLEASE READ THIS USER AGREEMENT AND THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE.

Your use of this site is expressly conditioned on your acceptance of the following terms and conditions.

The website and all its content have been produced by and are the property of Cleaner Climate Ltd. (“Cleaner Climate”) registered in England under company No. 5844588.

Sales

Cleaner Climate helps individuals and businesses assess their emissions through web based calculators. Cleaner Climate takes no responsibility for omissions or errors made by Purchasers when entering their information into web-based calculators.

When a Purchaser pays Cleaner Climate to offset their CO2 emissions, Cleaner Climate uses this payment (after bank fees and taxes including credit card transaction costs, VAT and GST) to fund a project pool that reduces CO2 emissions over time on the Purchaser’s behalf.

The Purchaser will receive by email a Certificate documenting that their emissions are being offset.

Purchasers do not receive title to the emissions reductions achieved by any of Cleaner Climate’s projects. As part of Cleaner Climate’s Assurance plan – each project is verified by an independent third party and no emissions reduction can be sold to more than one party.

Purchasers are not able to direct Cleaner Climate to allocate the funds to any particular project. Allocation is entirely at Cleaner Climate's discretion.

Accuracy of information

The information and methodology contained within Cleaner Climate’s web calculators has been compiled using the most up to date information published by reputable sources.

No guarantees or representation is made or warranty given (either express or implied) as to the completeness, accuracy or timeliness of the information on this website (in so far as such warranties may be excluded under any relevant law).

The emission factors used in Cleaner Climate’s web calculators can and do change over time and Cleaner Climate will endeavour to update the calculations as such new information becomes available.

Changes to or improvements in the calculations or projects available may be made at any time without prior notice. Should such changes be made, Cleaner Climate will not assume responsibility to alter its emissions reductions liability for calculations that it has done in the past.

Ownership

Content on this site remain the copyrighted property of Cleaner Climate and various third parties and may only be used or modified under license.

The trademarks, logos and service marks (collectively known as “Trademarks”) of Cleaner Climate and various third parties, are registered Trademarks of Cleaner Climate and various Third parties.

Nothing contained on this site should be construed as granting license to the use of any trademarks, intellectual property and content contained in this website without the written permission of Cleaner Climate or other third parties that may own the Trademarks.

Access to the content of this site by the use of the deep linking framing or caching is prohibited without the consent of Cleaner Climate.

Use of the site

Cleaner Climate grants you a limited, non transferable licence to use this site in accordance with the terms and conditions of this User Agreement. You may only use the site to contact us, access relevant member areas, read our content and use tools/calculators and shall not use this site for any other purpose.

This site and the content provided including text, graphics and button icons may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed without the written permission of Cleaner Climate and/or third party providers except that you may download, display and print the materials presented on this site for your personal, non-commercial use only.

You may not use any "robot," "spider" or other automatic device, or a program, algorithm or methodology having similar processes or functionality, or any manual process, to monitor or copy any of the Web pages, data or content found on this site, in any case without the prior written permission of Cleaner Climate.

You agree that you will not transmit or otherwise transfer any Web pages, data or content found on this site to any other computer, server, Web site, or other medium for mass distribution or for use in any commercial enterprise.

You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of this site.

You agree that you will not take any action that imposes a burden or load on our infrastructure that Cleaner Climate deems in its sole discretion to be unreasonable or disproportionate to the benefits Cleaner Climate obtains from your use of the site.

The results obtained from using any Cleaner Climate calculator(s) should be used as an indication only.
These results do not represent either quotes or offers for any product/service described, calculated or implied by any Cleaner Climate calculator(s).

Webmasters who place any Cleaner Climate calculator(s) on third party websites (and/or websites unaffiliated with Cleaner Climate), disclaim Cleaner Climate from all responsibility resulting in any form from the use of these calculator(s).

Whilst due care is taken to ensure that the calculator distribution is as functional as possible, Cleaner Climate disclaims all responsibility if the calculators are not functional on any external site at any time and for any period of time.

Cleaner Climate reserves the right to decide which domain addresses may access Cleaner Climate’s calculators and it may change this status at any time.

Age and responsibility

If you use this site, you are responsible for maintaining the confidentiality of your account information and your password (where one has been provided).

You agree to accept responsibility for all activities that occur under your account or password. You represent that you are of sufficient legal age to use this site and to create binding legal obligations for any liability you may incur as a result of the use of this site.

You understand that you are financially responsible for all uses of this site by you and those using your login information.

You have read the Cleaner Climate Privacy Policy, and agree that the terms of such policy are reasonable.

You consent to the use of your personal information by Cleaner Climate and/or its third party providers and distributors in accordance with the terms of and for the purposes set forth in the Cleaner Climate Privacy Policy.

Limitations

By accessing this website, you agree (and it is a term of such access) that Cleaner Climate will not be liable for any loss and/or damages whatsoever in connection with your use of this website.

In particular, but without limitation, Cleaner Climate will not be liable for any special, consequential or incidental damages or damages for loss of profits, loss of revenue, loss of use or loss of goodwill arising out of or in connection with this website or the information or material contained in it, whether any claim is brought in contract, or tort (including negligence) or otherwise.

Other information

Cleaner Climate provides certain (hypertext) links in this website that lead to websites which are not under the control of Cleaner Climate.  When you activate any such (hypertext) link, Cleaner Climate accepts no responsibility or liability whatsoever in respect of the material on any website which is not under the control of Cleaner Climate.

Laws

These terms and conditions of use and your access to this site shall be governed by the laws of England.

Termination

Cleaner Climate may terminate this User Agreement and/or the provision of any of the services at any time for any reason, including improper use of this site or your failure to comply with these terms and conditions.
Such termination shall not affect any right to relief to which Cleaner Climate and its third party providers may be entitled. Upon termination of this User Agreement, all rights granted to you will terminate and revert to Cleaner Climate and its third party providers.

Modification

Cleaner Climate may at any time modify these terms and conditions and your continued use of this site will be conditioned upon the terms and conditions in force at the time of your use and your access to this site shall be governed by the laws of England.

Severability

If any provision of this User Agreement shall be unlawful, void or unenforceable for any reason, then that provision shall be deemed severable to the extent that it is unlawful, void or enforceable, but shall not affect the validity and enforceability of the remaining provisions of these terms and conditions.

Headings

The headings in User Agreement are included for convenience only and will not limit or otherwise affect the terms and conditions herein

Entire agreement

This User Agreement, together with any terms and conditions incorporated herein or referred to herein constitute the entire agreement between us relating to the subject matter hereof, and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on this site.
